428R - Release of Students to Persons Other than a Parent/Guardian
A student shall only be released to his/her parent/guardian, unless the parent/guardian has provided the school with prior notification indicating the date(s), time(s) and name(s) of the individual to whom the student shall be released. The notification shall be documented.
If someone other than a student’s parent/guardian requests a student be released and the school has not received prior notification from the student’s parent/guardian, the school shall not release the student until a parent/guardian has been contacted and given the school permission to release the student.
Whenever an individual appears at a school to seek the release of a student, the school shall check the individual’s photo identification to determine if he/she is the student’s parent/guardian or an individual who has been granted permission by the student’s parent/guardian to pickup the student. In addition, the individual to whom the student is being released shall provide the school with the following information on the school’s student sign-out log:
- Student’s name
- Name of person to whom the student is being released and their relationship to the student
- Time of student release
The principal/designee is authorized to adopt further protocols for the release of students to persons other than a parent/guardian not otherwise inconsistent with this regulation.
In the event of an emergency or situation when extenuating circumstances exist, the principal or his/her designee may release a student to a “person with a legitimate interest” as defined in the Code of Virginia § 20-124.1.
