549P-A - Sick Leave Plan

  • Frederick County Public Schools shall provide sick leave benefits for all full-time and permanent part-time employees to be administered in accordance with the following provisions.

    1. Accrual of Sick Leave Allowances
      The accrual of sick leave allowances for all full-time and permanent part-time employees will be equal to one day for each contract month with a maximum accumulation of 150 days for employees covered by VRS Plan 1 and Plan 2 retirement plans and 25 days for employees covered by the VRS Hybrid retirement plan. For example, 10, 11, and 12-month employees will accrue 10, 11, and 12 days of sick leave each year, respectively. Note: Employees paid for additional days beyond the standard number of days for their position accrue sick leave based on the standard contract. Part-time employees, other than those specified above, shall receive no sick leave allowance.

    2. Utilization of Sick Leave Allowances

      1. Sick leave may be used for the following:

        1. Personal illness;

        2. Family illness: Available leave with full pay may be used for up to five (5) consecutive days in any one case of illness in the immediate family. ("Immediate family" includes: parents (natural, adoptive, foster), husband, wife, brother, sister, child, step-child, father-in-law, mother-in-law, daughter-in-law, son-in-law, brother-in-law, sister-in-law, stepmother, stepfather, grandmother, grandfather, grandchild whether or not living with the employee's household, or any other relative living with the employee's household.);

        3. Bereavement: Available leave with full pay may be used for up to five (5) days for the death of a family member other than the employee’s parent, spouse, child or stepchild. (NOTE: Bereavement for a parent, spouse, child, and/or step-child is provided for in 549R-A).

        4. Adoption of a child: Up to three (3) days may be used by an employee who adopts a school-age child, and up to twenty (20) days will be allowed when a preschool child is adopted. (Leave will be granted to one employee when both adopting parents are school board employees.)

      2. It is the employee's responsibility to make proper notification either to their supervisor or through the substitute employee management system for payroll purposes.

      3. All accumulated and accrued sick leave shall terminate upon expiration of employment. However, accumulated and accrued sick leave may be transferred to other divisions or institutions within the state if requested by an employee within two years from the resignation date.

        An employee will be presumed to have left the profession if he or she accepts employment other than in a public school system of Virginia or is unable to work in the public schools because of illness or physical disability or family responsibilities for a period of two consecutive years.

        Employees who leave the profession to enter the armed services do not forfeit accumulated earnings unless they fail to return to the profession immediately upon discharge from an original tour of duty in the armed services.

      4. Sick leave may be transferred by employees from another public school system or governmental agency in Virginia to the Frederick County Public Schools up to the maximum number of days allowed to be accumulated by the Frederick County Public Schools’ plan.

      5. Employees who do not begin working at the start of the school term or do not complete the full year will have their leave prorated based on the number of days actually worked.

      6. All sick leave pay shall be at the employee's current per diem rate in effect at the time of the illness.

    3. Verification of Illness
      The superintendent or designee may request that an employee, at the employee's expense, submit a physician's certificate verifying the illness upon which the sick leave request is based.
