559R - Military Leave

    1. Training or Active Duty Up to 15 Days
      Employees, who are members of the organized reserve forces of any of the armed services of the United States, National Guard, or naval militia, will be granted leave with pay on regular workdays during which they are engaged in annual active duty for training or when they are called forth by the Governor pursuant to provisions of the Code of Virginia. Paid leaves of absence for federally funded military duty, including training duty and active military duty, shall not exceed fifteen work days per federal fiscal year (October 1 to September 30).

      Employees called for military duty or training which is not made pursuant to a call by the governor, a national emergency, or conflict duty, are requested to seek alternative active duty assignment dates if the call to duty interferes with the instructional calendar, and if alternative dates are available to employees through their military unit(s).

    2. Active Duty Beyond 15 Days
      An employee on approved military leave shall accrue seniority, as if on active employee status, for salary and continuing contract eligibility. The employee may continue to participate in the group health programs by paying the full coverage premium. The employee may continue participation in the VRS life insurance plan for a maximum of two (2) months by paying the full premium. The employee will not accrue sick leave, personal leave, or annual leave while on approved military leave.

      Pension accruals in the Virginia Retirement System will not be credited while the employee is on military leave. However, if the employee returns to VRS covered employment within 12 months of honorable discharge, the employee may apply directly to VRS to receive credit for such military leave of absence. The granting of VRS service credit for military leave of absence is credited at no charge to the employee or school system.
